A “debt acknowledgment” saved a girl from losing 115,000 AED, which she had lent to a young man to help him out of financial distress, but he evaded repayment.
The Abu Dhabi Family and Civil and Administrative Claims Court ruled that the young man must pay the borrowed amount to the girl, along with 2,000 AED as compensation for the damages she suffered due to being deprived of the benefit of her money.
Details reveal that the girl filed a lawsuit against the young man demanding that he pay her 115,000 AED with interest, and 10,000 AED as compensation, along with legal fees and expenses. She indicated that she lent him the claimed amount to help him out of financial hardship, and he signed a debt acknowledgment agreement but refused to repay the amount.
She submitted copies of the agreement titled “Debt Acknowledgment Letter” as evidence for her claim.
The court stated in its ruling that the plaintiff filed the case based on being a creditor to the defendant for the claimed amount, and presented a written acknowledgment signed by the defendant, which included his borrowing of the claimed amount and acknowledgment of his debt to the plaintiff of 115,000 AED. The defendant did not appear despite being legally notified to present any defense or objection to the claim or the validity of his signature on the acknowledgment, or to provide evidence of his discharge from the claimed amount, so the court ruled to oblige him to pay the plaintiff the claimed amount.
Regarding the compensation claim of 10,000 AED, the court noted that according to the Civil Transactions Law, “any harm caused to others obliges the perpetrator, even if not fully capable, to guarantee the damage.” The court found the defendant’s fault established and that this fault caused material damages to the plaintiff by depriving her of benefiting from the claimed amount.
The court ruled that the defendant must pay the plaintiff 115,000 AED and 2,000 AED as compensation, along with legal fees and expenses.
