The Abu Dhabi Commercial Court – First Instance, ruled to reject a lawsuit filed by a car rental company demanding 18,650 AED from a lessee, representing traffic fines, fees, and damages. The court stated that the company did not provide evidence proving the date the defendant returned the rented vehicle. The company had requested the defendant to pay the fines, fees, and damages with a 12% annual late interest from the date the lawsuit was filed until full payment, in addition to consultancy expertise fees of 3,150 AED. The company claimed the contract was terminated by a court ruling and that the vehicle was returned about a year after the termination judgment. The traffic violations occurred during this period and were not paid despite amicable demands.
The court noted that the case documents lacked proof of the actual vehicle return date and that the plaintiff did not provide credible evidence to support the actual delivery date. The consultancy report did not specify the document it relied on to state the actual delivery date, and the plaintiff bears the burden of proof. The court ruled to reject the lawsuit in its entirety and ordered the plaintiff to pay the expenses and attorney fees.
