Law No. 202 of 2020 on Waste Management Regulation sets conditions for manufacturing, importing, and circulating plastic bags under special controls due to their environmental hazards.

Article 27 of the law states:

    • a) The manufacturing, importing, or exporting of single-use plastic bags shall comply with the controls, requirements, and technical specifications issued by a decision from the Minister of Trade and Industry in agreement with the competent minister. The decision may include a ban on manufacturing, importing, or exporting such bags if their components contain inputs or materials that severely harm the environment.
    • b) The sale, circulation, storage, free distribution, or disposal of single-use plastic bags is only permitted according to the controls, requirements, and technical specifications defined by the executive regulations of this law.
    • c) The Minister of Finance, in coordination with the competent minister and the Minister of Trade and Industry, shall issue a system of financial and economic incentives, tax and customs exemptions to encourage the import, production, and manufacturing of environmentally safe alternatives to single-use plastic bags. The executive regulations shall specify the standards and controls for these incentives and the specifications of safe alternatives, taking into account the advantages and conditions stipulated in existing laws and decisions, especially those related to investment, customs, industry, and cooperatives.
    • d) Facilities, individuals, and producers of these bags shall be granted a grace period to regularize their status, determined by a decision from the competent minister in agreement with the Minister of Trade and Industry.
