The Al Ain Court for Civil, Commercial, and Administrative Claims ruled to obligate a company to pay AED 466,465 to one of its employees, as it delayed paying his due wages for more than two years. The company also failed to pay his end-of-service gratuity and annual leave allowance despite the termination of the employment relationship.

Details reveal that the employee filed a lawsuit against the company where he worked, requesting a judgment obligating the company to pay overdue wages amounting to AED 420,000, an end-of-service gratuity totaling AED 24,465, annual leave allowance of AED 35,000, and compensation for notice pay of AED 15,000.

The employee based his claim on the fact that he worked for the company with a total basic salary of AED 15,000 and stated that on his last working day, the company refused to pay his dues. The court clarified regarding the overdue wages that it was proven that an employment relationship existed between them, and the employee demanded his overdue wages for a period of 28 months. The company did not provide the court with any written receipt or document proving that it had fulfilled these payments, as it was responsible for providing evidence. His monthly comprehensive salary was AED 15,000, thus he is entitled to overdue wages amounting to AED 420,000.

The court indicated that the employee’s service period was two years, four months, and six days, considering that he is entitled to 14 days per year, multiplied by the daily wage which equals AED 500. Therefore, he is entitled to an end-of-service gratuity of AED 16,465. He is also entitled to annual leave allowance for the last two years, with a balance of 60 days multiplied by the daily wage of AED 500, resulting in an amount of AED 30,000.
